Who Qualifies for CHAMPVA?

CHAMPVA covers the families of the most severely disabled veterans and the survivors of those who died from service-connected causes. The rules are specific, and getting them right the first time saves months. Here is the complete eligibility picture.

You may qualify if you are...

  • The spouse or child of a veteran rated permanently and totally disabled due to a service-connected disability.
  • The surviving spouse or child of a veteran who died from a service-connected disability, or who was rated permanently and totally disabled at the time of death.
  • The surviving spouse or child of a service member who died in the line of duty, not due to misconduct, when the family is not eligible for TRICARE.

The key concept: CHAMPVA covers the family, not the veteran. The veteran gets VA health care. The spouse and children get CHAMPVA.

The TRICARE rule

You cannot have both. If you are eligible for TRICARE, the Department of Defense program for military families and retirees, you are not eligible for CHAMPVA. If the veteran in your family is a military retiree, your coverage is TRICARE. CHAMPVA exists for families whose eligibility comes through VA disability ratings rather than military retirement. Rules that trip people up

  • Remarriage before 55. A surviving spouse who remarries before age 55 loses CHAMPVA. If that later marriage ends by death, divorce, or annulment, eligibility can be restored. Remarriage at 55 or older does not end eligibility.
  • Children age out at 18, or 23 in school. Coverage runs to age 18, and continues to 23 while the child is enrolled full-time at an approved school. Coverage can continue past those ages only for a child incapable of self-support due to a disability that began before 18, known as helpless child status.
  • Marriage ends a child's eligibility regardless of age.
  • Divorce from the veteran ends a spouse's eligibility.
  • Turning 65 brings a Medicare requirement. To keep CHAMPVA at 65 and beyond, you generally must enroll in Medicare Part A and Part B if you are entitled to them. CHAMPVA then pays second and covers most of what Medicare leaves. Details in CHAMPVA and Medicare.

The PACT Act effect

The PACT Act of 2022 dramatically expanded the list of conditions presumed service-connected, especially for toxic exposure. That means more veterans reaching permanent and total disability ratings, which means more spouses and children becoming CHAMPVA-eligible every month. If your veteran's rating recently changed to permanent and total, your family likely qualifies now even if it did not before.

How to apply

Apply with VA Form 10-10d, Application for CHAMPVA Benefits. If any family member has other health insurance, include VA Form 10-7959c. You can apply online through VA.gov, or mail the forms. Include copies of supporting documents such as the veteran's rating decision, marriage certificate, and birth certificates for children. Processing takes time, so apply as soon as you become eligible, and note that benefits are generally payable back to the eligibility date once approved.

Common questions

Does the veteran get CHAMPVA too?

No. The veteran receives care through the VA health care system. CHAMPVA covers the eligible spouse and children. One family can have both running side by side.

My veteran is 100% but not permanent and total. Does my family qualify?

Not yet. CHAMPVA requires the permanent and total designation, not just a 100 percent rating. If the rating becomes permanent and total, apply immediately.

Can a caregiver get CHAMPVA?

Yes, a primary family caregiver approved under the VA Program of Comprehensive Assistance for Family Caregivers can receive CHAMPVA if they have no other health insurance entitlement.

How long does CHAMPVA approval take?

Processing commonly takes several weeks to a few months depending on volume and whether your application is complete. A complete, well-documented first submission is the biggest thing you control.
